p.2 County Court - McDermott vs Berry - action brought by Thos. McDermott, a carver in wood, of this city, against Mr. Edward Berry, owner of the shipyard at Portsmouth. The amount claimed is $140, and is for carving done for Barque Aylestone - ornamental work for the bow and other parts of the vessel. The Defendant paid $80 into Court, as the amount which he considered the full value of the work done. The action is to recover the balance of $60. D. Macarow for the plaintiff; George L. Mowat for the defendant. The Jury returned a verdict for the plaintiff for $30 - properly for $110, as it includes the $80 paid into Court by the Defendant.
