p.2 County Court and General Sessions - Fraser vs. Welland R.R. - This was an action brought by the plaintiff, Samuel Fraser, as the Captain of the schooner B.W. Folger, for demurrage for detention of that vessel at Kingston in October, 1872. The schooner had a cargo of grain shipped by the defendants, and consigned to D. Ferguson, of Molson's Bank, Montreal, care of Montreal Transportation Company line, and the detention arose by reason of the number of vessels which had arrived here prior to the arrival of plaintiff's vessel. After all the evidence was given, the defendant's counsel took some legal objections, upon which the plaintiff was non-suited. Mr. J.M. Machar for plaintiff, and Mr. B.M. Britton for defendants.
