Mygatt (Canal Boat), sunk by collision, 11 Nov 1861

CASE IN ADMIRALITY. - The case of Alonzo Evans vs. the Schooner JOHN F. WARNER and T.P. Handy for damage to canal boat MYGATT, which was run into and sunk by the WARNER on the 11th. of November, 1861, was determined on the 8th, against the libellant, in the United States District Court, for the Northern District of N. Y., Hall, Justice. The evidence proved that the WARNER had been out in a storm during the night, and while coming into the Creek next morning under a heavy gale, carried away the stern of the MYGATT. The canal boat lay with stern extending out into the Creek, and no effort was made to haul her into safe quarters. The Justice held that under the circumstances the master of the canal boat was bound to exercise "extraordinary vigilance."
